关于严禁索要和收受“红包、回扣”的规定
第一条 为增强职工的职业道德意识，规范职业行为，倡导诚实守信、敬业爱岗精神，提升服务质量，维护病人的合法权益，参照有关法律法规，结合我院实际情况制定本办法。
第二条 本规定所指的索要和收受“红包”，是指患者在医疗单位诊疗期间，经治医务人员违反《中华人民共和国执业医师法》第三十七条第十款的规定，利用职务之便，索取、非法接受患者钱物。
第三条 本规定所指的索要和收受“回扣”是指在医药购销中医务人员或从事采购、管理的医院工作人员接受商业贿赂，违反《中华人民共和国执业医师法》第三十七条第十款的规定，利用职务之便，牟取其他不正当利益的行为（指收受或向卖主索要佣金，包括医务人员向患者推销药品与器材、患者直接向厂家购买而从中收取佣金或其他工作人员向厂家、店家收取佣金等）。
第四条 医务人员收到“红包”后，应立即退还病人或者病人家属，并在科室拒收“红包”登记本上记录，退还时由病人或者病人家属签字，医务人员要做好说明和解释工作。因特殊情况不能退还的，应在2个工作日之内报告科室负责人或医院纪检监察部门，由医院纪检监察部门人员负责
告知并退还给病人，退还方式可以是直接给病人或者病人家属，退还后需由患者或患者家属签字证明。也可以交住院处作为预缴金处理，预缴金的发票交病人保管，复印件交医院纪检监察部门留存。各科室拒收“红包”登记本将成为每年医院医德医风考评和评先评优的重要依据，对于表现突出的科室或个人将给予表扬或奖励。
第五条 医务人员没有正当理由逾期不告知、不上缴的，视为收受“红包”。索要或接受病人或家属“红包”的，被群众举报，经核查情况属实，除没收所得外扣发当事人3个月奖金，并视情节轻重给予相应行政处分。
第六条 医务人员及医院工作人员在收到药商或医疗器械供应商给予的各种形式的“回扣”后，应在2个工作日之内交到医院纪检监察部门，无正当理由逾期不缴的视为收受商业贿赂，一经查实，除给予严肃批评教育、责成当事人作出书面检查和追缴“回扣”外，给予待聘及相应的纪律处分；情节严重或造成重大影响的，上报卫生行政主管部门建议取消其执业医师资格或护士连续注册资格及相关执业资格；涉嫌犯罪的，移交司法机关处理。
第七条 医院纪检监察部门受理有关“红包、回扣”专项投诉，举报电话：2989357 、2989355。同时每年不定期的组织相关人员和社会监督员对“红包、回扣”等商业贿赂整治工作进行明察暗访，加强监督力度。对举报人实行严格
保密.
第八条 科主任为科室整治“红包、回扣”工作的第一责任人，要切实负起责任，认真执行《秦皇岛市第二医院医德医风奖惩细则》相关规定，以身作则，作廉洁行医、规范服务的模范执行者，不得为收受“红包、回扣”者说情、解脱，甚至有意包庇袒护。对放任自流，科内发生收受“红包、回扣”的，要追究科室负责人领导教育监督不力的责任，并与科室领导考绩紧密挂钩。
第九条 本规定从下发之日起执行。
