摘要
南海自古以来就是中国的固有领土，大量的历史文献及资料都可证明。但从上个世纪 70 年代开始，东南亚国家纷纷抢占南海岛屿。目前南海争端已成为全世界涉及国家最多、情况最复杂的海洋权益争端之一。菲律宾是东南亚国家中最早对南海提出“主权”要求的，是除越南之外占领南海岛屿最多的国家。2009 年2 月菲律宾通过《领海基线法案》将南沙部分岛屿与黄岩岛划为菲属。到 2014年，菲律宾共侵占南海8 个岛礁和沙洲，将几十万平方公里海域划为其领海。至今，菲律宾仍在南海不断挑衅制造事端，其行为侵犯了中国领土和主权的完整，制约了中国的经济增长，威胁了中国的国防安全，影响了中国在国际上的形象。
本文通过对菲律宾国内政治、经济、局势以及美国因素、《联合国海洋法公约》的颁布等问题的分析，来了解菲律宾挑战中国南海主权的内部、外部推动因素，从而来研究菲律宾挑战中国南海主权的原因。解决中菲南海争端有助于解决整个南海争端，特别是在当前短时期内解决整个南海争端无法实现的情况下，如果能将菲律宾当作突破口，从经济、政治、法律、国防等各方面努力，和平解决中菲之间的争端，受“多米诺骨牌”效应的影响，与其他国家的争端也会容易解决。中国是一个负责任的大国，一直致力于和平解决中菲南海争端，以求得和平、发展、双赢。中国希望与其他国家一起为促进地区经济和社会的可持续发展，为整个人类文明和世界和平与进步做出贡献。

Abstract
South China Sea, China's inherent territory since ancient times, a large number ofhistorical documents and information can be proved. However, beginning in the 70sof last century, the Southeast Asian countries have to seize the South China Seaislands. At present, the South China Sea dispute has become one of the world'sproblems. Maritime rights disputes involving the most countries, the situation is themost complex. The Philippines is the first Southeast Asian countries in the SouthChina Sea that “sovereignty” requirement is in addition to the Vietnamese occupationof the South China Sea countries, the largest island. By February 2009 the PhilippinesBaselines Act NAN SHA Islands and Huang Yan Island section designated as thePhilippine. By 2014, a total occupation of the Philippines South China Sea islands andreefs and 8shoals, will draw hundreds of thousands of square kilometers sea of itsterritorial waters. So far The Philippines continues to provoke the South China Seaand still in causing troubles, Their behavior violated China's territorial integrity andsovereignty, which restricts the growth of China's economy, threaten China's nationalsecurity, affected China's image in the international arena.
Through the analysis of the Philippine domestic political, economic situation ,theUS factor, and “the United Nations Convention on the Law of the Sea” ,this pater tryto learn internal and external factors when Philippines challenges South China Seasovereignty and internal. To resolve the South China Sea dispute between China andthe Philippines will help solve the entire South China Sea dispute. Especially thewhole situation under the South China Sea dispute can't be solved immediately. If canregard Philippines as a breakthrough, in the efforts from all aspects of economic,political, legal, defense, Peaceful settlement of disputes between China and thePhilippines will affect other countries to solve disputes more easily just like the“domino”. China has been committed to the peaceful settlement of disputes in NanHai to show a responsible big country, in order to achieve peace, development and awin-win. China hopes, together with other countries to promote sustainable economicand social development of the region, for the whole of human civilization andcontribute to world peace and progress.
